    "The county attorney's computer systems are sorely outdated. For example, they only have Dot Matrix printers, Needless to say, it's time for an upgrade. If she purchases the new equipment using forfeiture funds, do we have to go out for bids?"

    Are purchases made with forfeiture funds subject to the County Purchasing Act?

    Yes. Attorney General Opinion DM-2.46 states that purchases made with funds generated by forfeitures under Chapter 59 of the Code of Criminal Procedure are subject to the County Purchasing Act. For more information regarding forfeiture funds, see our Special & Dedicated Funds handbook.
