"The county clerk announced in August she plans to retire and sent a resignation letter to the commissioners court indicating she will leave office efective December 31st."

May a resignation of a county office be set to take effect at a future date?

Yes, the date a resignation is effective is not necessarily the same as the date the vacancy is effective. For purposes of filling the vacancy, the authority with whom the resignation was filed may appoint upon receipt and acceptance of the resignation and the newly appointed office may take office on or after the designated resignation date. Texas Election Code §201.023
