    Fireworks/Burn Ban

"We have a very concerned citizen in our county that despises fireworks. He's threatening to file a petition to prevent the county from allowing fireworks during the holiday season. I've never heard of such a thing. Can he really do that?"

Does the public have the right to petition to implement or repeal the regulation of fireworks?

No. However, Local Government Code §352.051(h) allows a citizen to file suit for an injunction to prevent a violation or threatened violation of the order restricting the sale or use of fireworks. For more information about the regulation of fireworks, see our publication Burn Ban, Regulation of Fireworks, and Declaration of Local Disaster.
