    The Texas Association of Counties has highlighted recent Attorney General Opinions and Requests for Opinions of interest to counties. Summaries below are republished directly from opinion letters issued by the Office of the Attorney General without substantive editing.

    Attorney General Opinions

    KP-0476: Asks whether a district clerk may refuse to electronically file a document in a criminal case based on the district clerk's opinion that the document fails to comply with the Judicial Committee on Information Technology Standards (RQ-0543-KP). The opinion provides a district clerk may not refuse an electronically filed document in a criminal case based on the district clerk's opinion that the document fails to comply with technology standards set by the Judicial Committee on Information Technology (JCIT). However, a clerk's return of documents for correction pursuant to JCIT technology standard section 4.8.4 and Rule 2.6 of the Statewide Rules Governing Electronic Filing in Criminal Cases does not constitute a refusal of such documents.

    Requests for an Attorney General Opinion

    RQ-0567-KP: House Committee on Pensions, Investments, and Financial Services. Questions relating to the scope of third-party obligations resulting from child support liens under Family Code Chapter 157.

    RQ-0568-KP: Senate Committee on Natural Resources & Economic Development. Questions the authority of the Texas Ethics Commission to toll its obligation under Government Code section 571.1242(g) in circumstances beyond litigation.

    RQ-0569-KP: Grayson County Criminal District Attorney. Asks whether a county is obligated to provide emergency services to residents of unincorporated areas.

    RQ-0570-KP: Cherokee County Auditor. Asks questions about the authorities and obligations regarding phone-card sales at a county jail.

    RQ-0571-KP: Angelina County District Attorney. Asks questions related to the enforceability of bond conditions.

    RQ-0572-KP: Cooke County Attorney and 235th Judicial District Attorney. Asks whether county officials, other than the District Attorney, can exercise control over asset-forfeiture funds.

    RQ-0573-KP: Caldwell County Criminal District Attorney. Asks questions related to the scope of county authority and liability involving utility cables buried along rights-of-way.
