"Our auditor was just notified by the tax assessor-collector that one of our elected officials is delinquent on their property taxes. It’s a new pay period, and it’s turned into an awkward situation. What do we do?"

Can the county make payments to a person with an outstanding debt to the county?

Under Local Government Code §154.025, the county treasurer or auditor may not pay the elected official until first notifying them in writing of the indebtedness and the debt is paid. A county may garnish any payment to the official if notice of such is included in the original notice from the treasurer or auditor.
