Private Road sign "A landowner is willing to trade good rock in exchange for one of our road crews to do some work on his private road. Can the county do the work on a private road?"

May a county perform work on a private road?

It depends on the county's population. If the county's population exceeds 7,500, it cannot repair or maintain a private road or property under Tex. Const. Art. III, Sec. 52f. See also Attorney General Opinions JC-0503 (2002), JM-0334 (1985), and JM-0200 (1984). For more information on county roads, see our publication Common Road and Bridge Questions.
