"Our neighboring county to the west is selling some excess road equipment that our county could really use. Can we skip the competitive bid process?"

May we sell the county's surplus or salvage property to another county without competitive bid or auction?

Yes! Local Government Code §263.152 provides that the commissioners court of a county may periodically sell the county's surplus or salvage property by competitive bid or auction, except that competitive bidding or an auction is not necessary if the purchaser is another county or a political subdivision within the county that is selling the surplus or salvage property.

TAC has developed a new, convenient option for buying and selling county vehicles and equipment: the County Trading Post. Learn more about the service and check out our publication on county purchasing Basics of the County Purchasing Act and Competitive Bidding.
