    "One of our county vehicles was parked on a hill without the emergency brake on. Long story short...it's not at the top of the hill anymore, and there's no chance of driving it back up there either. Does the court have to declare it surplus before its scrapped?"

    Must Commissioners Court declare a totaled vehicle surplus before it is scrapped by the insurance carrier?

    No! Covered vehicle is subject to surrender under the insurance policy and isn't considered surplus or salvage.
